Acceptable Use

You agree not to:

Not Medical Advice or a Crisis Service

SoberWave is a self-help and motivation tool. Day counts, money saved, Surf sessions, Talk it out, mood reports, menu scans, and tricky place warnings are not medical, psychological, or addiction treatment, and they do not replace a doctor, counselor, therapist, or recovery program. Talk it out is not a counselor or therapist, and its responses are not professional advice.

Stopping drinking can be dangerous for some people. If you drink heavily or every day, alcohol withdrawal can cause serious symptoms. Talk to a doctor before you stop, and get medical help right away if you feel unwell.

The menu scanner reads text from a photo and marks a line "likely alcohol-free" only when nothing alcoholic is listed on it. It can misread text and cannot see ingredients a menu leaves out. Always confirm with staff before you order. Tricky place warnings depend on your device's location and may arrive late or not at all.

SoberWave is not monitored and cannot send help. If you are in crisis or thinking about harming yourself, call your local emergency number right away. In the US, you can call or text 988.

Intellectual Property

The Application, including its design, illustrations, stickers, headlines, features, graphics, and content (excluding your User Content), is owned by the SoberWave Team and protected by copyright, trademark, and other intellectual property laws. Map imagery is provided by Apple and is subject to Apple's terms. You may not copy, modify, distribute, or create derivative works from the Application without our prior written consent.

Termination

We may suspend or terminate your access to the Application at our discretion, including for violation of these Terms. You may stop using the Application and delete your data at any time. Termination does not entitle you to a refund for any unused subscription period, except as required by law or platform policy.

Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that day counts, money-saved figures, photo captions, menu scans, location warnings, or Talk it out responses will be accurate, complete, error-free, or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law, the SoberWave Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of or inability to use the Application, including any health outcome, relapse, or consequence of relying on a menu scan, a missed or late tricky place warning, or a Talk it out response.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date, and where required, we will notify you through the app. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the SoberWave Team operates, without regard to conflict-of-law principles, except where applicable consumer protection laws provide otherwise.
